Terms of Service

These terms of service (the "Terms") govern access to and use of the LYZY platform, available at https://lyzy.io and through its applications (the "Service"). The Service is published by NEXUS TECH STACKS (N.T.S), a sole proprietorship owned by Pascal Adama SARR, registered with the RCCM under number SN MBR 2025 A 3405, NINEA 012480315, located in Nianing, Malicounda, M'Bour department, Thiès region, Senegal (the "Publisher" or "LYZY").

LYZY is a career platform: it lets candidates create, import and optimize their resumes and cover letters, browse job offers and, if they wish, be visible to recruiters. It lets organizations publish job offers and search for talent.

The Privacy Policy and the Legal Notice form an integral part of these Terms. Please read them carefully. For any question, write to us at contact@lyzy.io. These Terms are a translation: in case of discrepancy, the French version prevails.

1Purpose and scope

The Terms set out the conditions under which the Publisher makes the Service available, and the rights and obligations of the parties. They form a contract between the Publisher and any person using the Service, whatever their profile: visitor, candidate, partner or recruiter, acting in a personal or professional capacity.

Specific terms (for example an institutional offer, a quote or a recruiter contract) may supplement the Terms. In case of conflict, the specific terms prevail over the Terms for the matters they govern.

2Definitions

  • User: any person who accesses or uses the Service, with or without an Account.
  • Account: the personal space created at signup, protected by credentials.
  • Candidate: a User who uses the Service for their job search or career development.
  • Partner: a professional User authorized by LYZY to publish job offers.
  • Recruiter: a professional User authorized by LYZY to access the Talent Pool.
  • User Content: the information, text, images, resumes, letters, documents and offers that a User creates, imports or publishes through the Service.
  • Offer: a job, internship or assignment offer published on the Service.
  • Talent Pool: all Candidate profiles made visible to Recruiters with each Candidate's explicit consent.
  • AI Features: features relying on artificial intelligence, including automatic resume import, cover letter generation, the match score between a resume and an Offer, tailoring a resume to an Offer and the resume audit.
  • Pack: a prepaid bundle of credits usable for certain paid services.
  • Subscription: a prepaid pass of fixed duration granting usage quotas.

3Acceptance and changes to the Terms

Using the Service means accepting the Terms. Creating an Account also requires ticking the box accepting the Terms and the Privacy Policy. The accepted version and the date of acceptance are recorded and are binding between the parties.

The Publisher may change the Terms, in particular to reflect legal, technical or commercial developments. The date of the current version appears at the top of the document. In case of a material change, Account holders are informed and must accept the new version at their next sign-in to keep using their Account. They remain free not to accept it and to delete their Account.

The Terms are written in French and may be translated. In case of discrepancy, the French version prevails.

4Access to the Service and Account

The Service is available to persons aged at least 16. Between 16 and 18, the User declares that they have the permission of their legal guardian.

Signup uses a valid email address and a password, or a Google account. The User provides accurate information and keeps it up to date. The email address must be verified before some features can be used. Each person may hold only one Candidate Account.

The User is responsible for keeping their credentials confidential and for any activity carried out from their Account. They report any unauthorized use without delay to contact@lyzy.io.

Partner and Recruiter access is reserved for professionals acting on behalf of a company, organization or public body. It is granted after verification by LYZY, which may refuse or withdraw it without having to give reasons if there is doubt about the identity or legitimacy of the applicant.

5Services

5.1 Resume builder. LYZY provides a guided editor, layout templates, a real-time preview and PDF export of the resume.

5.2 Resume import. The User may import an existing resume (PDF or DOCX). Its content is extracted automatically using the AI Features to prefill the editor. The User checks and corrects the result.

5.3 Cover letters. LYZY generates cover letters from the information provided by the User, who can then edit and export them.

5.4 AI and ATS features. LYZY computes a match score between a resume and an Offer, suggests a version of the resume tailored to an Offer and audits the resume's compatibility with recruiters' screening software (ATS). These results are decision aids and carry no guarantee.

5.5 Job offers. LYZY publishes Offers posted by Partners or by its own team. Some Offers are taken from public sources, with their origin stated and a link to the original posting. Applications are made directly to the employer, on its website or by email: LYZY does not forward applications and is not a party to the recruitment process.

5.6 Talent Pool. Candidates may choose to make their profile visible to Recruiters, under the conditions of article 8. This option is off by default.

5.7 Professional spaces. Partners have a space to publish and manage their Offers. Recruiters have a space to search, view and export profiles from the Talent Pool.

The Service evolves regularly. The Publisher may add, change or remove features without this giving rise to compensation, provided the User is not deprived of a service already paid for and not yet delivered.

6Financial terms

6.1 Principle. Creating an Account, creating and saving resumes and browsing Offers are free. Some services are paid, including downloading a resume, generating a cover letter, Packs and Subscriptions. AI Features may be free, paid per use, or reserved for Subscribers after a single free trial, as shown in the Service.

6.2 Prices. The applicable prices are those shown in the Service at the time of the order, in CFA francs (XOF), including all applicable taxes. Service fees may be added: they are shown before the payment is confirmed. The Publisher may change its prices at any time; a new price does not apply to orders already paid.

6.3 Packs. A Pack grants a number of credits usable for the services stated at purchase. Credits are not refundable, cannot be exchanged for cash and cannot be transferred to another Account.

6.4 Subscriptions. A Subscription is a prepaid pass of fixed duration (for example 1, 3, 6 or 12 months) granting a monthly quota per feature. The quota renews at each monthly period of the Subscription; unused quota does not roll over. The Subscription ends automatically at the end of its term, with no automatic renewal or charge: the User renews it if they wish.

6.5 Promo codes and offers. Promo codes and special offers are subject to the conditions stated when they are issued (duration, number of uses, eligible services). Unless stated otherwise, they cannot be combined and cannot be converted into cash.

6.6 Payment. Payment is made with Wave or Orange Money. It is confirmed by the operator, whose terms apply to the payment transaction. The Publisher never collects or stores the User's secret code. The service is delivered as soon as the payment is confirmed.

6.7 Immediate delivery. Paid services are digital content and services delivered immediately after payment. By confirming the order, the User requests this immediate delivery and acknowledges that, to the extent permitted by applicable law, they can no longer exercise a right of withdrawal for a service already delivered.

6.8 Technical failure and claims. A service that fails for a technical reason attributable to the Service is not charged: the corresponding credit is not consumed or is restored. Any other claim relating to a payment must be sent to contact@lyzy.io within 30 days of the transaction, with its reference. If the paid service was not delivered, the Publisher delivers it again or refunds the amount paid through the operator used.

6.9 Professional offers. Access to the Talent Pool (per-view access or a recruiter subscription with an export quota), publishing Offers and institutional offers may be paid. Their prices and terms, including billing on quote or invoice, are set out in the Service or in the specific terms agreed with the Publisher.

7User obligations

When using the Service, the User undertakes to:

  • comply with the Terms, applicable laws and regulations and the rights of third parties;
  • provide only accurate, honest and up-to-date information, in particular in their resumes (identity, degrees, experience);
  • not publish third parties' personal data (text, photos, contact details) without their consent;
  • not publish content that is unlawful, misleading, defamatory, abusive, obscene, discriminatory, violent, inciting hatred or contrary to public decency, or content infringing intellectual property rights;
  • not use the Service for advertising or marketing purposes, or to send unsolicited messages;
  • not impersonate anyone or create several Accounts, in particular to benefit more than once from a free trial or a promotional offer;
  • not circumvent the payment, quota or security mechanisms of the Service;
  • not access the Service by automated means (bots, scripts, scraping), and not repeatedly and systematically extract or reuse all or part of its data, in particular Offers or profiles;
  • not decompile, disassemble or attempt to reproduce the Service's code, disrupt its operation or place a disproportionate load on its infrastructure.

8Talent Pool

8.1 Candidate consent. A profile is visible in the Talent Pool only with the Candidate's explicit consent, given from their Account. This option is off by default. The Candidate chooses the resume they publish and may withdraw consent at any time from their Account, with immediate effect for the future.

8.2 Visible information. Recruiters see the content of the published resume, including the contact details it contains. Unpublished documents, cover letters and the Candidate's AI Feature results are not shared with them.

8.3 Traceability. Every view and every export of a profile by a Recruiter is logged. The Candidate can obtain the list of companies that viewed or exported their profile, under the conditions set out in the Privacy Policy.

8.4 Effect of withdrawal. Withdrawing consent removes the profile from the Talent Pool. It does not recover copies already exported by Recruiters, who remain bound by the obligations of article 9.

9Partner and Recruiter obligations

9.1 Publishing Offers. The Partner warrants that its Offers correspond to real and available positions, that it is authorized to publish them and that they comply with applicable law, in particular the Labour Code. It refrains from any discriminatory wording (origin, sex, religion, opinions, disability, family status, union membership or any other prohibited criterion), any misleading or pyramid Offer or disguised sale, and any request for payment addressed to candidates, for any reason. LYZY may moderate, refuse, change the presentation of or remove an Offer that does not comply with the Terms.

9.2 Use of the Talent Pool. The Recruiter uses the profiles viewed or exported solely for its own recruitment needs. It refrains from selling, transferring or publishing them, using them for marketing purposes or combining them with other files for other purposes.

9.3 Access. Recruiter access is personal and may not be shared. The Recruiter ensures that only authorized persons within its organization use its access and is liable for their actions.

9.4 Data protection. For the data it views or exports, the Recruiter acts as an independent data controller. It complies with Law No. 2008-12 of 25 January 2008 on the protection of personal data and, where applicable, any other applicable regulation. It informs the Candidate at first contact that their details were obtained through LYZY, deletes a Candidate's data upon request and, in any event, no later than two years after its last contact with them.

9.5 Sanctions. Any breach of this article may lead to the immediate suspension or termination of access, without refund of amounts paid and without prejudice to any damages.

10User Content

The User retains the rights to their User Content. They warrant that they hold all rights needed to publish it and that it infringes no third-party right or legal provision.

Solely for the purpose of providing the Service, the User grants the Publisher a non-exclusive, royalty-free, worldwide license, for as long as the User Content is hosted, to store, reproduce, adapt (layout, extraction, generation, analysis), display and, for profiles published in the Talent Pool or published Offers, communicate it to the relevant Users. This license extends to the Publisher's technical providers acting on its behalf.

The Publisher acts as a host of User Content. It does not review such content in advance and has no general monitoring obligation. Any manifestly unlawful content may be reported to contact@lyzy.io, stating the location of the content and the reason for the report. The Publisher acts promptly to remove or disable access to unlawful content it becomes aware of.

11Intellectual property

The Service and each of its elements (structure, design, interfaces, resume and letter templates, text, logos, trademarks, databases, software), excluding User Content and third-party content, are the exclusive property of the Publisher or its licensors and are protected by national and international intellectual property laws.

The Publisher grants the User a personal, non-exclusive and non-transferable right to use the Service in accordance with the Terms. Candidates may freely use, print and share the resumes and letters they have downloaded for their professional purposes.

Any other reproduction, representation, extraction or reuse of all or part of the Service or its databases, in particular for commercial purposes or to build a competing service, is prohibited without the Publisher's prior written consent.

12Artificial intelligence

AI Features rely on artificial intelligence models supplied by specialized providers. Their results (extracted or generated text, scores, suggestions, tailored resumes, audits) are produced automatically and may be incomplete, inaccurate or unsuitable.

The User reviews and checks these results before using them and remains solely responsible for the documents they share. A match score or an audit is an indicative estimate: it does not reflect a recruiter's decision and guarantees neither an interview nor a job.

LYZY makes no recruitment decision and does not select candidates. The User refrains from submitting unlawful content to the AI Features or using them to produce misleading documents.

13Role of LYZY

LYZY provides tools and a space where candidates and employers can meet. The Publisher is not an employer, a placement agency, a recruitment firm or an agent of Candidates or Recruiters. It takes no part in selecting candidates, interviews, negotiations or the conclusion of an employment contract.

The Publisher does not guarantee the accuracy of published Offers and profiles, nor the quality, solvency or intentions of Users. Everyone should remain vigilant, in particular about an Offer requesting a payment or sensitive information, and report it to LYZY.

14Availability of the Service

The Publisher uses reasonable means to keep the Service accessible and working 24 hours a day, 7 days a week. It has an obligation of means and does not guarantee that the Service will be free of interruptions, errors or vulnerabilities.

Access may be suspended for maintenance or updates, which the Publisher tries to carry out outside peak hours and to keep short. The User is responsible for their own equipment and internet connection.

15Liability

The User uses the Service at their own risk. They are solely responsible for their User Content, for how they use the Service's results and for the relationships they form with other Users.

The Publisher is liable only in case of proven fault on its part. It is not liable for indirect damages, such as loss of opportunity, employment, income, customers or data, nor for damages resulting from a breach by the User, the act of a third party or force majeure.

The Service may contain links to third-party websites, including employers' websites. The Publisher has no control over these websites, to which the Terms do not apply, and accepts no liability for their content.

The User acknowledges that the internet involves risks (interception, viruses, unavailability). It is up to them to keep their own copies of important documents.

To the extent permitted by law, the Publisher's total liability to a User, for all causes combined, is limited to the amount paid by that User to the Publisher during the twelve months preceding the event giving rise to liability. These limitations do not apply in case of gross negligence or willful misconduct by the Publisher, or where the law prohibits them.

16Term, suspension and termination

The Terms apply for as long as the Service is used. The User may stop using the Service and delete their Account from their settings at any time. Deletion is permanent: data is handled as described in the Privacy Policy, and unused credits, quotas and Subscriptions are lost without refund.

In case of breach of the Terms, the Publisher may suspend or terminate the Account concerned after a formal notice that remains unanswered for 8 days. In case of serious breach (fraud, unlawful content, security attack, misuse of Talent Pool data), suspension or termination may take place immediately, without notice.

The Publisher may delete an Account that has been inactive for three years, after warning the User by email. The articles on intellectual property, liability, Recruiter obligations and governing law survive the end of the contractual relationship.

17Personal data

The processing of personal data carried out as part of the Service is described in the Privacy Policy, in accordance with Law No. 2008-12 of 25 January 2008 on the protection of personal data and its implementing regulations.

18Force majeure

Neither party is liable for a delay or failure resulting from a force majeure event within the meaning of Senegalese law, including a widespread telecommunications or power outage, a payment operator failure, a large-scale cyberattack, a natural disaster or a decision of the authorities. Performance of the affected obligation is suspended for the duration of the event.

19Miscellaneous

If any provision of the Terms is held void or unenforceable, the other provisions remain in force. The Publisher's failure to enforce a breach does not waive its right to do so later.

The Terms, supplemented where applicable by specific terms, form the entire agreement between the parties regarding use of the Service. Data recorded by the Service (acceptances, orders, payments, logs) is binding between the parties unless proven otherwise.

The Publisher may assign the Terms to any entity taking over all or part of the Service's business, provided Users are informed.

20Governing law and disputes

The Terms are governed by Senegalese law, including the Code of Civil and Commercial Obligations and Law No. 2008-08 of 25 January 2008 on electronic transactions.

In case of dispute, the User first contacts the Publisher at contact@lyzy.io to seek an amicable solution. Failing agreement within 30 days, the dispute is brought before the competent Senegalese courts, subject to mandatory consumer protection rules, which may allow consumers to bring proceedings before another court.
